Payments, Refunds & Cancellations
Client Engagement and Project Initiation
Project initiation occurs upon the client’s remittance of an initial deposit. This deposit is predicated upon a verbal agreement concerning the project’s scope and associated costs, subsequently formalized by an invoice. The payment of this initial invoice, or any subsequent invoice, constitutes the client’s unequivocal acceptance of these Terms & Conditions.
Payment Terms and Methods
Specific payment terms, including initial deposit percentages, milestone payment schedules, and accepted payment modalities, shall be determined and agreed upon on an individual basis with each client. These details will be comprehensively documented within the respective project proposal or invoice.
Late Payments
In instances where a client fails to remit payment by the due date and does not establish communication with TriState Web Developers regarding the delay, all ongoing project work shall be immediately suspended until a resolution concerning the outstanding payment is achieved. We reserve the right to suspend services, including website hosting and access, for accounts with overdue balances.
No Refunds & No Cancellation Policy
TriState Web Developers does not issue refunds. Upon the remittance of any payment, the commencement of work is deemed to have occurred. Consequently, all payments are non-refundable. Subsequent to the remittance of any payment, cancellation is not permitted.
Rights, Responsibilities & Liability
Revisions and Feedback
During the course of a project, one (1) round of revisions to the design or development work is encompassed within the agreed-upon project cost. Any subsequent alterations may incur supplementary charges, which will be communicated and mutually agreed upon prior to implementation.
Client-Provided Content & Delays
Clients bear sole responsibility for all content furnished to TriState Web Developers. By submitting content, the client warrants that they possess all requisite rights. TriState Web Developers shall assume no responsibility for the accuracy, copyright compliance, or legality of client-provided content. We shall not bear responsibility for delays attributable to the client’s failure to furnish agreed-upon content or feedback in a timely manner.
Intellectual Property Rights
Upon the full and final payment for a project, the client shall acquire ownership of the intellectual property rights pertaining to the completed website. Notwithstanding this, TriState Web Developers retains the right to exhibit the completed work within its professional portfolio.
Limitation of Liability
TriState Web Developers shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits or data.
